1. Agreement
These Terms of Use (“Terms”) are a contract between you and DOTEC Elevators (“Company”, “we”, “us”) governing access to our website and online resources. If you do not agree, do not use the website.
2. About our services
DOTEC Elevators provides elevator, lift, and escalator-related services including supply, installation, annual maintenance contracts (AMC), breakdown support, modernization, spare parts, and safety-related work, primarily in Andhra Pradesh and Hyderabad (Telangana), India. Website content is informational; binding service terms are set out in separate quotations, work orders, AMC agreements, or contracts signed with you.
3. Permitted use
You may use the website only for lawful purposes. You must not:
- violate any applicable law, including Indian cyber and penal laws;
- attempt unauthorized access to our systems or data;
- introduce malware, scrape excessively, or disrupt website operation;
- misrepresent your identity or affiliation;
- upload or transmit unlawful, defamatory, or infringing content;
- use the site in any manner that could harm the Company, users, or public safety.
We may suspend or terminate access for breach of these Terms or under the IT Act and Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, where applicable to our hosting of user-provided content.
4. Intellectual property
Text, logos, images, videos, layouts, and software on this website are owned by or licensed to the Company and protected under the Copyright Act, 1957, Trade Marks Act, 1999, and other laws. You may not copy, modify, distribute, or create derivative works without our prior written consent, except for limited personal, non-commercial viewing or sharing of links to our pages.
5. Enquiries and electronic communication
Submitting an enquiry does not create a contract until we issue a written acceptance (including email) and any required advance payment or documentation. Communications under the Information Technology Act may be valid in electronic form where law permits.
6. Consumer protection (India)
If you are a “consumer” under the Consumer Protection Act, 2019, your statutory rights (including remedies for defective services or unfair trade practices) are not excluded by these Terms. For complaints, contact us at contact@example-dotec.com or our Grievance Officer (see Privacy Policy). You may also approach the appropriate District Consumer Commission or National Consumer Helpline (1915) as applicable.
Where we sell goods or services through e-commerce channels, we comply with applicable disclosure requirements under the Consumer Protection (E-commerce) Rules, 2020, including accurate service descriptions and grievance redressal.
7. Disclaimer of warranties
The website and content are provided on an “as is” and “as available” basis without warranties of any kind, to the fullest extent permitted by Indian law. See our Disclaimer for safety and technical limitations.
8. Limitation of liability
To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, special, or consequential damages arising from website use. Our aggregate liability for claims relating solely to the website (not governed by a separate service contract) shall not exceed INR 5,000 or the amount you paid us for the specific online transaction giving rise to the claim, whichever is lower, except where liability cannot be limited under Indian law (including consumer protection or death/personal injury caused by negligence).
9. Indemnity
You agree to indemnify and hold harmless the Company from claims arising from your breach of these Terms, misuse of the website, or violation of third-party rights, to the extent permitted by law.
10. Force majeure
We are not liable for delays or failures due to events beyond reasonable control, including natural disasters, strikes, government actions, or widespread network failures.
11. Privacy
Personal data is handled as described in our Privacy Policy.
12. Governing law and dispute resolution
These Terms are governed by the laws of India. Subject to consumer forum jurisdiction, courts at Andhra Pradesh shall have exclusive jurisdiction. We encourage good-faith resolution through our Grievance Officer before litigation.
13. Severability and assignment
If any provision is held invalid, the remainder remains in effect. We may assign our rights under these Terms in connection with a merger or business transfer; you may not assign without our consent.
